How does the law view non-human animals?
The legal system views animals as property. Animals do not have legal standing—the ability to bring a lawsuit in court on their own behalf. Even an animal's guardian (“owner”) may not bring a suit on the animal's behalf; she may only sue to protect her own property interests in the animal. In cases of animal cruelty, criminal charges may only be brought by the state prosecutor. However, a growing number of judges and jurisdictions are beginning to recognize that animals are different from a kitchen table or a pair of shoes and carry a much greater emotional value than mere property.
